General Terms and Conditions (GTC) of 2nd Peak GmbH, Version 07/2024

SCOPE OF APPLICATION

These General Terms and Conditions (hereinafter "GTC") apply to all orders placed and contracts concluded via the online shop of 2nd Peak GmbH (https://2ndpeak.ch) or in the branch. 2nd Peak GmbH reserves the right to amend the GTC. All legal transactions are concluded with 2nd Peak GmbH unless otherwise agreed. All deliveries, services, and offers from 2nd Peak GmbH are made exclusively on the basis of these GTC. The version of the GTC applicable at the time of the order is decisive and cannot be unilaterally amended for that order.

PRODUCTS

2nd Peak GmbH endeavours to state the product characteristics as precisely as possible, including the colours. The products in current advertising, in the online shop, or in the 2nd Peak branch are sold exclusively in the respective specified versions, specifications, and recommendations. Technical changes arising from technological progress or changes in form, colour, and weight remain reserved. The colour of certain products may differ from the variant shown in the online shop.

ORDER / CONCLUSION OF CONTRACT

SHOPPING CART

Items in the shopping cart are not considered reserved and are not deemed a binding order.

ORDER

After submission of a successful order, the customer receives an automatically generated order confirmation by email stating that the order has been received via the online shop. After receipt of this confirmation, the customer can no longer amend the order and is bound by it.

CONCLUSION OF CONTRACT

A purchase contract is concluded upon dispatch of the ordered goods. As soon as the order has been dispatched, the customer receives a shipping confirmation by email.

PRICES / PAYMENT OPTIONS

PRICES

For the purchase and ordering of goods and services from 2nd Peak GmbH, the prices applicable at the time of purchase apply. The prices stated in the online shop and in current advertising refer to the date of issue. Price changes remain reserved. Prices are quoted net in Swiss francs including the statutory Swiss value added tax. Price changes remain reserved. Additional incidental costs incurred (processing or payment fees, shipping costs, etc.) or other additional costs (consequential costs) are listed separately and invoiced separately. In all cases, this requires the customer's prior consent after transparent disclosure of such consequential costs during the selection of the payment method.

ELECTRONIC PAYMENT METHODS

Credit cards (Visa, Mastercard), Twint, and PostFinance are accepted as electronic payment methods. For payments by credit card, the amount is debited upon shipment of the goods.

Purchase on invoice is not possible.

DELIVERY, SHIPPING COSTS / AVAILABILITY OF GOODS

If 2nd Peak GmbH is unable to meet a binding delivery deadline for reasons beyond its control (short-term unavailability of the goods), the customer will be informed as quickly as possible. If the product is no longer available, both contracting parties are entitled to withdraw from the contract with respect to the relevant products. Any consideration already provided by the customer in respect of the unavailable goods will be fully refunded by 2nd Peak to the customer in such a case. The statutory rights of the contracting parties remain unaffected.

DOMESTIC DELIVERY

Goods are dispatched as quickly as possible and usually take two to three working days (if the order is received by 14:00). Delivery costs are borne by the recipient and are also settled by credit card payment.

DOMESTIC SHIPPING COSTS

A shipping cost share of CHF 8.50 is charged for each order.

INTERNATIONAL DELIVERY

Orders from abroad cannot be accepted.

SERVICES

EXCHANGE/RETURN

2nd Peak GmbH grants customers a right of exchange/return for all items purchased in the online shop. A return is only possible if the item is returned in perfect condition within 14 calendar days from the date of purchase or brought back to a 2nd Peak GmbH branch. The customer must notify 2nd Peak GmbH of the exercise of the right of withdrawal within the withdrawal period by phone or in writing by letter or email to the following address: 2nd Peak GmbH, Pilgerweg 70, 8802 Kilchberg, info@2ndpeak.ch. The delivery note must be enclosed. The return shipping costs are borne by the customer.

DATA PROTECTION

2nd Peak GmbH ensures confidential handling of all customer data; disclosure of this data to third parties is excluded. By purchasing or ordering a product in the online shop, the aforementioned GTC of 2nd Peak are deemed accepted.

Use of individual elements of the website requires the written consent of 2nd Peak GnbH. Despite content checks, 2nd Peak assumes no liability for the content of external links. The operators of the linked pages are solely responsible for their content.

DISCLAIMER
Use of the 2nd Peak GmbH website is at your own risk. No liability is assumed for the use of the services or their unavailability. This also applies to any consequential damage from products. Price changes and errors in product descriptions remain reserved. The use of our online offerings is recorded. All recorded information is data that does not allow any conclusions to be drawn about individuals and is therefore anonymous. Data recording enables analysis of customer use of the online offerings so that we can align our offerings even more closely with customer needs. The technical and organisational measures take account of Swiss data protection laws.

JURISDICTION

Place of performance and jurisdiction is Zurich.

SEVERABILITY CLAUSE

Should a provision of this contract be invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace the invalid provision with a valid arrangement that comes as close as possible to that provision.

CHANGES TO THE GTC

2nd Peak GmbH reserves the right to amend or supplement the GTC at any time. The valid version can be found at www.2ndpeak.ch
